Data Subject Protection Statement
Logwise AB provides certain compliance services to clients in order to help them follow EU financial regulations through the means of web based applications (the “Logwise service” or “Service”). If you have been invited to the Logwise service it is because you either have legal obligations under EU financial regulations or you are involved in managing compliance for an organisation under relevant legislation.
Logwise is committed to data protection and secure processing of all data in the Service. As a user we want to inform you about the basis for processing your data and how your data is used.
Please be aware that the terms and policies applied to data processing for the Service differ from the terms and policies applied to other web sites that Logwise publishes.
Basis for collecting personal data
The use of information collected through the Logwise service is limited to the purpose of providing the Service to clients who have engaged Logwise for providing such services.
All collection of data is initiated by our clients, Logwise provides processing of data entirely under the direction of clients. Logwise has no direct contractual relationship with individual users of the Service, the basis for our processing is to fulfil the contractual obligations we have with our clients. As such each client has signed a Data Processing Agreement with Logwise and our terms of service contain confidentiality clauses regulating the sharing and dissemination of data collected into the Service.
The Service is used for fulfilling EU financial regulations, thus the basis for our clients to collect personal data into the Service is one of a) legal requirements set out in EU regulations to collect personal data, b) consent through policies of employment, service contracts or similar. When personal data is collected from you in the Service you will have received an email explaining the reason for requesting information from yourself.
All processing of personal data is performed in accordance with the contract that the client has entered into with Logwise, general details of which can be found under our service terms.
Data Subject rights
When the basis for collecting your personal data is a legal requirement of EU regulations there is also a requirement to retain all such information for a minimum period of 5 years. During this period deletion of data is not allowed under the relevant legislation. Logwise will retain data for as long as is deemed necessary by our clients in providing the Service to them.
Correction of data can be performed by yourself. When personal data has been collected from you, you will also have received an email informing you of the reason for collecting the data. In this email is also information about how to update the personal data collected from you. Should you have any issues with correcting the information contact the person responsible for adding you to the Logwise service, this person is named in the email sent to you.
Similarly to view the data collected about yourself you can view the data in the Logwise service by following the links in the emails sent to you. Should you have any issues accessing this data contact the person responsible for adding you to the Logwise service.
If you have any questions, need support in amending incorrect data or have a request related to your personal data which cannot be resolved through the instructions above please contact Logwise at [email protected]. Logwise will make reasonable commercial efforts to provide such support free of charge. If we determine that requests are unfounded or excessive we reserve the right to charge for any such support, you will be informed of the estimated cost prior to fulfilling the request.
Usage
The personal data that the Logwise service can collect is limited to basic identifying personal data.
The data collected is processed using automated means by Logwise and is not shared with any other organisations except as required in the processing that is provided to our clients through the designated sub-processors which are listed with our terms of service.
If required to fulfil regulatory obligations, your information may be shared with relevant government agencies or regulatory authorities with oversight over Logwise or our clients. In any such case the minimum amount of information required to fulfil the obligations will be provided.
The Logwise service uses necessary cookies for providing the Service and monitoring the functioning of the application. In the case non-essential cookies are used for analytics or other non-essential purposes you will be notified and allowed to accept or decline the use of such cookies. Logwise also collects certain technically personally identifiable information such as IP address, browser type etc which is stored in technical logs for a limited period of time to enable support, failure correction and security monitoring. The basis for such processing is Logwise legitimate interest to ensure the Service functions as expected and maintains sufficient security.
Data Protection Officer
Logwise has assessed that the processing performed in providing the Service does not fulfil the requirements stated in the GDPR where a DPO is required, therefore Logwise has no appointed DPO at this time. We regularly revisit this assessment, in the case a DPO is appointed this policy will be amended.
Amendments
Logwise may amend this policy from time to time. The latest version will at all times be available on this web site. You are advised to consult this policy regularly for any changes.
If we make significant changes to the policy that materially alter our privacy practices, we may also notify you by other means, such as sending an email or posting a notice in the application prior to the changes taking effect.
